Did you compile in "Packet Socket" ? If you did it as the module af_packet.o, you may need to add the following line to /etc/conf.modules:
alias net-pf-17 af_packet
Otherwise tcpdump will not work, cf linux/Documentation/Configure.help (search CONFIG_PACKET).
