ns_capable() eventually gets you to an audit call. The audit code is going to do the locking. Fortunately, the preceding cap_issubset() is the check that we really need here.

That can't be right, can it? Determining that we have PTRACE_MODE_SCHED at this point should result in -EPERM. I mucked up on the logic flow. The next revision will fix this.
