And it's caused by:

fc_probe(...) {
...
spin_lock(&fc_lock);
ret = misc_register(&fc->misc);
...
}

misc_register() will do schedule while spin_lock() disabled the pre-empt
already.

Alessandro, if fc_lock won't be used in atomic context, may be make it a
mutex-lock will be better ;-)
