That commit went in 3.10, but this fix hasn't been applied to 3.10.y.
David, this code moved from net/ipv4/tcp.c to tcp_offload.c after 3.10 and this patch applies textually after adjusting the filename. Please consider including it in the next batch of stable fixes for 3.10.
