There are other ways hda1 could be busy, such as used for swap or member of a RAID array. But I guess this is not the case here?

You may also want to try cfdisk /dev/hda and see that the partition layout is the same as with 2.4, and you might want to check if cat /dev/hda > /dev/null works. This is all very strange, but more data might get more people interested.
